⚠️ Important information
Commercial names and botanical varieties
The names of our CBD flowers correspond to their aromatic profiles and organoleptic characteristics, which can change depending on the harvest. The commercial name may therefore differ from the botanical variety mentioned on the certificate of analysis.
Example: A flower of the Cannatonic variety with pronounced lemony notes will be marketed under the name "Lemon Haze" or "Lemon Kush", to facilitate the identification of its characteristic aromas.
🇪🇺 European free movement and mutual recognition
CBDTech is a French company. According to Articles 34 and 36 of the TFEU and the principle of mutual recognition ("Cassis de Dijon" judgment, CJEU 1979), products legally manufactured in one EU Member State can be marketed freely in other Member States.
Kanavape judgment (CJEU, 11/19/2020, C-663/18): The CJEU confirmed that CBD products legally produced in a Member State can be sold in France according to the principle of free movement, with European law taking precedence over national law.
📋 European THC regulations
Each European country applies its own regulations regarding the authorized THC level. Our flowers are intended for different European markets:
-
Switzerland, Czech Republic: up to 1% THC
-
Italy: up to 0.6% THC
-
Netherlands: up to 0.5% THC
-
France, Austria, Luxembourg: up to 0.3% THC
-
Germany, Spain, Belgium, Portugal: up to 0.2% THC
⚖️ Specific French regulations
In France, the threshold of 0.3% THC applies to growers at the time of harvest. The official analysis is carried out on the fresh plant. After drying and storage, the THC level can naturally vary due to the evolution of cannabinoids. The legal reference analysis remains that carried out by the farmer during the harvest.
📊 Understanding Certificates of Analysis
What is “Total Potential”? Our certificates mention a “potential total THC” which represents the sum of neutral THC (Δ9-THC) and THCA (acid form) after conversion.
Technical explanation: During intense heating (combustion, vaporization), the acid forms (THCA, CBDA) decarboxylate to become active (THC, CBD). The total potential simulates complete decarboxylation, with a conversion factor between 0.867 and 0.878.
French legal compliance: French regulations are based on Δ9-THC (neutral form) which must be ≤ 0.3% during agricultural analysis at harvest.
🍵 Intended use
Our flowers are exclusively intended for infusion and must not be smoked. When infused at low temperatures, THCA does not transform into active THC by decarboxylation. The actual level of psychoactive THC therefore remains well below the potential total indicated.
